HARTFORD, Conn. - The Connecticut Supreme Court has ruled that a longtime activist trying to shut down the Millstone nuclear power complex has the right to challenge its operating license.
The unanimous ruling released Wednesday says a lower court should not have ruled that Nancy Burton of the Connecticut Coalition Against Millstone has no standing.
Burton had sued in 2007 with a list of allegations aimed at the way Millstone uses water for cooling in Waterford.
The ruling says that Burton's original complaint challenging the renewal of Millstone's operating license should be heard.
The court says she sets out facts to support her claim that unreasonable pollution will probably result from Millstone's operation.
The ruling means that Burton's challenges must be heard by the lower court, not simply dismissed.
